Moderator: Ian Fox, INSOL Fellow, Dentons, UK

Ian is a partner in the Restructuring and Insolvency practice, focusing on all areas of contentious insolvency and asset recovery work (including major commercial litigation). He also has significant experience in restructuring and non-contentious insolvency work, and has advised insolvency practitioners, lenders, governments, corporates and directors in relation to insolvency issues in sectors including infrastructure, construction, energy, real estate, retail and sport.

Ian has a particular interest in cross-border and international insolvencies and in April 2018 he graduated as a Fellow of INSOL International. He is also closely involved with representative organizations in the UK insolvency market, as a member of the City of London Law Society Insolvency Law committee, and the R3 education and courses committee.
 

Rachelle Frisby, INSOL Fellow, Deloitte, Bermuda

Rachelle is the head of Financial Advisory in Bermuda and the British Virgin Islands, providing restructuring, forensic and dispute, business valuation, M&A transaction, and AML compliance services. She has over 15 years of experience working in public accounting in Canada and Bermuda. 

Rachelle has been appointed as co-receiver and/or co-liquidator by The Supreme Court of Bermuda. Her responsibilities included implementing schemes of arrangement for reinsurance companies, negotiating proceeds from a synthetic equity interest, and overseeing the management of and selling commercial and personal property.

Rachelle has overseen a wide range of advisory engagements for local and regional clients including conducting independent business reviews of debtor clients of financial institutions, and conducting forensic investigations of suspected employee theft as well as regulatory breaches. She has also provided acquisition due diligence and valuations services for financial services and consumer businesses.

Rachelle has overall responsibility for a team that specializes in providing accounting, corporate administration, and payroll outsourcing services. She achieved her Bachelor of Commerce in Accounting at University of British Columbia in Canada. She is a member of CPA Canada and Bermuda. She is a Fellow of INSOL International, a worldwide federation of accountants and lawyers who specialize in turnaround and insolvency. She is also a Certified Fraud Examiner.
Rachelle serves on the board of Restructuring and Insolvency Specialists Association of Bermuda (RISA) and the Bermuda School of Music.

Sunny Hathiramani, Tanner De Witt, Hong Kong

Sunny Hathiramani first joined Tanner De Witt as a paralegal in 2008. He completed his Postgraduate Certificate in Laws from the City University of Hong Kong in 2010 and rejoined Tanner De Witt as a trainee solicitor shortly after. Sunny was admitted as a solicitor in Hong Kong in 2012 and was made Partner in 2019.

Sunny has extensive experience in advising on a range of insolvency and restructuring issues, in relation to both companies and individuals. He has represented clients in complex commercial, winding-up and bankruptcy disputes, advising insolvency practitioners, shareholders, creditors and debtors, including in respect of cross-border issues.

Sunny also advises and represents directors and companies in regulatory matters, including investigations by the Securities and Futures Commission and the Confederation of Insurance Brokers Disciplinary Committee.

Sunny holds a BSc (Hons) in Biomedical Sciences from King’s College London and attained his Graduate Diploma in Law from BPP Law School, London.

Lisa Schweitzer, Cleary Gottlieb, USA

Lisa M. Schweitzer’s practice focuses on financial restructuring, bankruptcy, insolvency and commercial litigation.
She has advised clients in some of the most high-profile bankruptcy matters in North America, and her work repeatedly has been recognized by the business and legal press, including The American Lawyer, which previously named her a “Dealmaker of the Year.” Among her many highlights, Lisa is lead U.S. restructuring counsel to Nortel Networks Inc. and affiliates in their U.S. Chapter 11 proceedings. She has extensive experience advising corporate debtors, individual creditors and strategic investors in both U.S. Chapter 11 proceedings and restructurings in other jurisdictions in North America, Europe and Asia. Lisa also has represented several companies seeking to acquire distressed assets in bankruptcy proceedings.

Andrew Thorp, Harneys, BVI

Andrew Thorp is a partner and Head of our Litigation, Insolvency and Restructuring group in the BVI, where he specialises in cross-border asset recovery and insolvency work. His clients include law firms, banks, funds, private equity houses and trust companies.
Andrew is a recognised industry leader and largely focuses on pre-emptive remedies, including freezing orders, provisional liquidations and discovery orders, often against a background of fraud. He has a prolific track record of successful asset retrieval operations across CIS, Latin America and Asia. He is known for his strategic approach and effectiveness; clients benefit from his commerciality and insight. Additionally, Andrew has pioneered a number of cross-border protocols between court officers and is regularly retained to advise on the restructuring of international distressed structures.
